Putting a Price on AI Training Data

Generative AI models are trained on reams of data collected from the open web. Some large organizations (Reddit, news publishers) receive remuneration for providing this training data, but millions of smaller creators do not. Several factors limit an inclusive market for AI training data to emerge, including transaction costs and the difficulty of price-setting (in the presence of market power). Four legal frameworks have tried to deal with these issues before: Data Acts, bargaining codes, the excessive pricing doctrines, and standard essential patent negotiations. We consider how their features can inspire a governance framework for the market for AI training data.
About the Speaker:
Friso Bostoen is an assistant professor of competition law and digital regulation at Tilburg University. Previously, he was a Max Weber Fellow at the European University Institute. He holds degrees from KU Leuven (PhD, LLM) and Harvard University (LLM). Friso’s research focuses on competition policy for digital markets. His work has resulted in numerous international publications, presentations, and awards (including the AdC Competition Policy Award 2019 and the Concurrences PhD Award 2022).
