This lecture will focus on the recent Privy Council decision in Dawson-Damer v Grampian [2025] UKPC 32 and will consider the state of the law concerning the exercise of dispositive discretions by trustees and in particular whether the law is now clear and settled, or whether important questions remain to be answered.

 

About the Speaker

Richard Wilson KC is a barrister at Serle Court in London, specialising in trusts and estates law across a wide range of jurisdictions, including all of the principal offshore jurisdictions. He has appeared in many of the leading trusts and estate cases of the past 20 years, including Futter v HMRC, Wong v Grand View and Dawson-Damer v Grampian. In addition to litigation, Richard has a substantial advisory practice, assisting trustees with restructuring or stress-testing trusts. Many of his cases have an Asian element and he acts for many clients based in this region.
