About sixty years ago, Herbert L. Packer published his famous theory regarding two models of criminal justice, in which he favored due process model and criticized crime control model. Alongside the due process model, the philosophy of criminal justice has overembellished due process in the past decades, due to the anxiety of wrongful convictions and the ignorance of wrongful liberty. While a bunch of literatures have been selling the due process in nature that it is better that N (as large as you can imagine) guilty offenders escape than that one innocent suffered, few criminologists and criminal law professor think over the price of due process is finally not to control crime and the innocents remains suffered. Although global society witnessed the twofold miscarriage of justice, the challenge and disease of modern criminal justice is just many guilty offenders escaped from punishment. Thus, it is time to change the criminal justice education in law school, criminology, criminal justice, not to teach students, professionals, and the public that criminal justice system should let the guilty go free in the context of due process. Alternatively, the justification of criminal justice is to promise safe society with less crime, rather than a large number of real crimes but a small number of convicted criminals. In this speech, I would share with my theory of philosophy of modern criminal justice, due process with crime control. Unlike Packer’s theory to overstate due process, my theory addresses that due process should serve for the purpose of crime control, and crime control should be the philosophical justification of criminal justice.

熊謀林,西南財經大學法學院教授、博士生導師,刑事法學研究所所長。他曾擔任《光華法學》執行主編,現任四川省刑法學研究會副會長、四川省刑事執行法學研究會副會長,亞洲犯罪學學會中國分部會長和執行委員會理事、中國犯罪學會學會理事、中國法學期刊研究會理事、中國刑法學研究會理事、華人犯罪學會終身會員等。他的研究廣泛涉及規範刑法學、比較法、犯罪學、刑事司法、法律史學、經濟學等領域,擅長實證(定量)分析,主要研究青少年違法、死刑、罰金(贖刑)、量刑公正、司法錯誤等。2013年3月入職西南財經大學法學院,主講中國刑法、刑事政策學、實證法學導論。他已主持國家社科基金“罰金刑在現代刑罰體系中的地位(2013)”,司法部課題“預防與糾錯:全球刑事錯罪對中國司法的啟示(2013)”,教育部課題“中華贖刑原論”。已在《中國社會科學》《清華法學》《政法論壇》《法制與社會發展》《中外法學》《法學》,以及Psychology, Law and Crime、British Journal of Criminology、European Journal on Criminal Policy and Research、Feminist Criminology、Chinese Journal of Comparative Law、Asian Journal of Criminology、China Review、Nature-HSSCOMS 等中外期刊發表論文60餘篇,並有8篇文章被人大複印期刊、中國社會科學文摘等轉載。
