Criminalizing Cyberflashing and Other Forms of Online Sexual Harassment

With increasing social awareness of the harms of image-based sexual violence, there has been growing calls for the criminalisation of various types of online sexual harassment: among them is “cyberflashing” – the digital distribution of unsolicited genital images. The UK has been at the forefront in regulating cyberflashing with their Online Safety Bill, but many activists are arguing vehemently against the current draft that requires an “intent to cause distress” and are advocating for a consent-based model instead. In this webinar, Professor Clare McGlynn will lay out the rationales for criminalising cyberflashing, and critically evaluate the legislative options to do so. Jacey Kan, senior advocacy officer from Hong Kong’s Association Concerning Sexual Violence Against Women will also join as a discussant, to give us an overview of online sexual harassment in Hong Kong.

Professor McGlynn is a Professor of Law from Durham Law School. She is a leading expert in the legal regulation of pornography, sexual violence and online abuse, in particular cyberflashing and image-based sexual abuse. She regularly provides oral evidence to UK parliamentary inquiries and committees to propel legal reform in the aforementioned areas, and is often featured in the media such as BBC documentaries and ITV news.

隨著社會對「影像性暴力」的危害的認識不斷提高，將各類型的網絡性騷擾刑事化的呼聲越來越高，當中包括「網絡暴露（cyberflashing）」，即未經同意以數碼方式傳播生殖器官影像的行為。英國政府早於2022年提出《網絡安全法案》以監管網絡暴露，但該草案要求被告有「對受害人造成困擾的意圖」方能成功入罪。當地倡議者強烈反對當前的條文，認為法案應該採用基於「同意（consent）」的立法模式。在這次網絡研討會上，杜倫大學的Clare McGlynn教授將闡述網絡暴露刑事化的理由，並深入分析各種立法框架的可取性。本地組織關注婦女性暴力協會的資深倡議幹事簡敏棋亦會以與談人身份加入討論，為我們介紹香港網絡性騷擾的情況。

McGlynn教授為英國杜倫大學法律學院的法學教授。她專攻色情刊物、性暴力和網絡性暴力（尤其是網絡暴露和影像性暴力）等議題的立法規管。 她多次為英國議會質詢和委員會提供口頭證據，並經常現身於英國各大媒體，以推動上述領域的法律改革。
