HKU CCPL TALK - The Decline of Political Offence Exception and the Protection of Human Rights: from International Extradition to Domestic National Security Legislation

As a poorly defined and chaotically applied principle, the political offence exception in international extradition has been facing decline both in theory and in practice. However, the human rights protection, as its important underlying rationale, does not lose any significance, neither does it lose the safeguards with the decline of the traditional principle per se taking the whole extradition mechanism into account. To some degree, its decline offers a chance to lay bare the real gaps of the different national security legislations on rights protection and suggest the necessary legal and institutional improvement for closer cooperation.

 

Speaker

Dr Yanhong Yin is a young researcher of criminal law and human rights law. She holds a Doctor of Laws degree from Vrije Universiteit Brussels with the exchange study experience in Cambridge and UCLA. She is now a member of European Criminal Law Association (UK). She published a series of articles regarding EU-UK extradition, US interstate rendition and European arrest warrant. She published her book “The Idea of a China Arrest Warrant: Surrender of Fugitive Offenders between Mainland China, Hong Kong and Macau” with Hong Kong University Press in February 2025. She also translated the book “The Political Offence Exception to Extradition: the Delicate Problem of Balancing the Rights of the Individual and the International Public Order” written by former ICC judge Christine Van den Wyngaert into Chinese. The translated book was published in January 2026.
