With particular reference to the UK system, the lecture will explore the historical process by which law has become central to our understanding of what a constitution is and what it is for. A significant chapter in that story is AV Dicey’s invention of the concept of “the rule of law”.

 

Peter Cane is a Senior Research Fellow at Christ’s College, University of Cambridge and Emeritus Distinguished Professor of Law at Australian National University. His main research interests are in public law, especially comparative administrative law; private law, especially tort law; and legal theory, especially concepts of responsibility. He is a Corresponding Fellow of the British Academy, and a Fellow of the Academy of the Social Sciences in Australia and the Australian Academy of Law. He is the author of Controlling Administrative Power (Cambridge University Press, 2016), Administrative Tribunals and Adjudication (Hart Publishing, 2009), Responsibility in Law and Morality (Hart Publishing, 2002) and The Anatomy of Tort Law (Hart Publishing, 1997).
