 U.S. Personal Jurisdiction and Chinese Companies

Abstract:

Globalizing Chinese companies increasingly find themselves sued in U.S. courts, with such varying claims as breach of contract, IP infringement, product liability and sanction violation.  How and when to invoke a personal jurisdiction defense is as much an art as legal science, and is often outcome-determinative.  Alex will share the latest U.S. personal jurisdiction jurisprudence based on his 20+ years of practicing in New York at major law firms, through the lens of four recent U.S. appellate cases involving Chinese defendants. There will be ample room for interaction both during and after the talk. 

 

The cases to be highlighted are:

  • N. Am. Sugar Indus. v. Xinjiang Goldwind Sci. & Tech. (11th Cir. 2025)
  • Am. Girl v. Zembrka (2d Cir. 2024)
  • Williams v. Binance (2d Cir. 2024)
  • Hawkeye Gold v. China Nat’l Materials Indus. Imp. & Exp. (8th Cir. 2023)

 

Speaker:

Alex Hao is a partner at the New York office of JunHe and acts as outside general counsel to Chinese companies doing business in the U.S. and globally.  Alex is arbitrator at AAA-ICDR (New York) and SIAC (Singapore), adjunct professor at Fudan International School of Finance, and co-chair of the Private International Law Interest Group of the American Society of International Law.  He enjoys studying French, German, Latin and Spanish.  Alex obtained his J.D. from Northwestern University and LL.B. from Peking University.
