China’s Foreign Investment Law and Its Role in a Time of Uncertainty

Abstract

In 2019 amid the US-China trade war, China adopted the Foreign Investment Law (FIL) to replace the existing fragmented laws and regulations. The FIL, which is based on the pre-establishment national treatment and negative list, forged one of the most liberalist foreign investment regimes in the world, and is thus pro-investment per se. To the surprise of the observers, however, recent years saw a decline of the incoming foreign investment in China and even a wave of foreign investment exit. The talk is going to offer some interpretations to the limits of the FIL in a time of uncertainty.

 

Speaker

Professor KONG Qingjiang is the Dean and Professor of Law at the School of International Law, China University of Political Science and Law. Specializing in international economic law, the WTO law and China issues, he has published over 50 articles in international journals, including Journal of International Economic Law, Journal of World Trade, International and Comparative Law Quarterly, Heidelberg Journal of International Law, Asian Journal of WTO & International Health Law and Policy, Journal of Intellectual Property Law & Practice and Cambridge Journal of China Studies. He has published ten books in English and Chinese. His recent book “China’s Foreign Investment Law amid Evolving International Investment Rules” was published by Springer in 2023. Professor Kong is the laureate of the Anzijie International Trade Prize and has served as Vice President of the WTO Law Research Society of the China Society of Law, Vice President of the China Society of International Economic Law, Executive Director of the China Society of International Economic Law, International Law Advisor of the Ministry of Foreign Affairs of PRC and Columnist of China Global Television Network (CGTN).
