內容提要:
回顧⾹港基本法制定的歷程,再訪基本法制定中的重⼤爭議問題,正視基本法制定的依法⽴法、⺠主⽴法和科學⽴法的特徵,重溫基本法制定過程形成的“基本法共識”,堅定維護憲法和基本法為基礎的憲制秩序。
Abstract:
This talk will revisit the historical context surrounding the making of the Hong Kong Basic Law and re-evaluate the major controversial issues that emerged during its enactment. It will also examine the legal, democratic, and scientific characteristics of the legislative process of the making of the Basic Law, as well as the “Basic Law Consensus” that took shape during the process, so as to firmly uphold the constitutional order formed on basis of the Constitution and the Basic Law.

葉海波,法學博士,現為深圳大學法學院教授,兼任國務院發展研究中心港澳研究所高級研究員、中國法學會憲法學研究會常務理事、中國法學會香港基本法澳門基本法研究會理事、廣東省人民政府立法諮詢專家、廣東省法學會首席法律諮詢專家、廣東省法學會香港基本法澳門基本法研究會秘書長、深圳市法學會粵港澳大灣區法治建設青年研究會會長等。 主要研究憲法學與行政法學、港澳基本法、國家監察等理論與實踐問題,發表《特別行政區基本法的合憲性推定》等論文多篇,出版《國家監察制度改革研究》等著作多部,主持《香港“客卿”司法的實證研究》等國家社科基金、教育部項目多項。
Speaker:
Haibo Ye holds a Doctor of Laws degree and is a professor at the Law School of Shenzhen University. In addition, he serves as a Senior Researcher at the Institute of Hong Kong and Macau under the Development Research Center of the State Council, Executive Director of the Constitutional Law Research Association of the China Law Society, and Director of the Hong Kong Basic Law and Macao Basic Law Research Association of the China Law Society. He is also a Legislative Advisory Expert for the Guangdong Provincial People’s Government, Chief Legal Consultant Expert of Guangdong Law Society, Secretary-General of the Hong Kong Basic Law and Macau Basic Law Research Association of Guangdong Law Society, and Chairman of the Shenzhen Law Society Youth Research Association for the Construction of the Rule of Law in the Guangdong-Hong Kong-Macao Greater Bay Area, among other roles. His primary research interests include theoretical and practical issues in constitutional law and administrative law, Hong Kong and Macao Basic Law, and national supervision. Haibo Ye has authored numerous papers, such as “The Presumption of Constitutionality of the Basic Law of the Special Administrative Region,” and published a series of books, including “Research on the Reform of the National Supervision System.” Moreover, he leads multiple projects for the National Social Science Fund and the Ministry of Education, such as “An Empirical Research on the ‘Keqing’ Judges in Hong Kong.”
