Law tech talk - The Unstable Gatekeeper to Data Privacy: The Identifiability Problem in Transnational Privacy Regulations

Date: Tuesday, November 15, 2022

Time: 1pm – 2pm (Hong Kong Time) via Zoom

Speaker: Dr. Xiaowei Yu (Post-Doctoral Fellow, Law and Technology Centre, Faculty of Law, The University of Hong Kong)

Abstract: Technology companies have made billions of dollars surveilling people through online cookies, smart devices, and algorithms, yet people disagree on when data privacy laws should intervene. The crux lies in the standard of identifiability. Applying identifiability involves a determination on whether data can identify a person. As a general rule, no privacy violation legally occurs unless data are personally identifiable. Disagreements over when data are personally identifiable arise. In this Law Tech Talk, Dr. Xiaowei Yu will focus on data privacy laws in three critical jurisdictions—EU, U.S., and China and demonstrate what the identifiability problem is in transnational privacy regulations.

About the speaker: Dr. Xiaowei Yu is a Post-Doctoral Fellow at the Law and Technology Centre of the University of Hong Kong Faculty of Law. Xiaowei earned her Doctor of the Science of Law (JSD) from the University of Illinois Urbana-Champaign College of Law (U of I), which was fully supported by China Scholarship Council (2017-2021). Prior to her JSD, Xiaowei completed her LLM at the U of I. She also received her master’s degree of jurisprudence and LLB from China University of Political Science and Law (CUPL). During her time in Illinois, she served as the JSD chair (2017-2019) and a member of The Elder Law Journal (2017-2018). Xiaowei participated in the US v. Christensen capital murder trial and acted as a liaison for the victim’s family (2019).
