摘要:

從比較法和哲學的視角研究案例制度，能夠得出令人信服且意外的發現。在西方法律史的早期，案例作為判例，既是法律，也是正義的體現。但由於法律與社會的原因，中國古代並不存在案例法。案例的歷史發展特點反映出中國與英國傳統法律文化的差異。同時通過哲學考察，我們可以對案例的特點與本質有更深刻和全面的理解。這種認識不僅有助於我們建設中國的案例制度，也將有力推進法治進程。

講者:

張騏，北京大學法學院教授，中國法學會法理學研究會副會長、比較法學研究會副會長、案例法學研究會副會長、最高法院案例指導工作專家委員會委員、北京市公安局法律顧問專家委員會委員；主編《法理學十六講》，發表文章出版專著若干；長期參與最高司法機關關於建立與發展案例指導制度的討論，先後赴哈佛、耶魯、牛津、海德堡和慕尼黑等作訪問研究。
